FDA peptide compounding policy is pending White House review

Bar chart of low, median, and high calendar-month continuing prices for sermorelin injection, oral sermorelin, NAD+ injection, NAD+ nasal spray, oral NAD+, and glutathione injection.

OIRA lists a pending FDA notice, "Interim Access Policy for Compounding Using Certain Peptides" (RIN 0910-ZD94, HHS/FDA, stage Notice). Received 14 October 2026, no legal deadline, not economically significant. It is pending EO 12866 review. As of 17 October 2026 the policy has not been issued, and its text and covered peptides are not public.

Reuters reported on 15 October 2026 that the filing gives no details of the policy. The report said the Associated Press, citing two people familiar with the matter, described compounding of some popular peptides, including BPC-157, and that those peptides are not FDA-approved as safe or effective. Reuters also reported that Hims & Hers had said it plans to offer peptides if regulations permit.

Holland & Knight wrote on 16 October 2026 that no peptide has been added to the 503A Bulks List. It said the Pharmacy Compounding Advisory Committee voted on 23-24 July 2026 to recommend BPC-157, KPV, TB-500, MOTS-c, Epitalon, and Semax, and against Emideltide (DSIP). BPC-157, KPV, and TB-500 each passed 8-6 with one abstention. The votes are advisory. FDA staff briefing documents dated 29 June 2026 had recommended against all seven. The firm's analysis, not an FDA decision, is enforcement discretion for state-licensed 503A pharmacies: no product approval, no research-use-only, supplement, or 503B coverage, and withdrawal without rulemaking. The firm expects a lasting federal pathway in 2027-2028.
